Al Pscholka, a former Republican state representative from Michigan, introduced a bill last year that would have permitted medically frail inmates to be cared for in licensed health care facilities rather than prisons. The bill passed the House, but did not make it through the Senate because of funding concerns.

The law allows the DOC, DMHAS, and Social Services commissioners to establish or contract for a nursing home to care for individuals who require nursing home levels of care and are transitioning from a state correctional facility or receiving DMHAS inpatient services. A 2012 budget act provision allows the DOC commissioner to release inmates who meet certain criteria into licensed, community-based skilled nursing homes under contract with the state. 60 West, a privately-owned facility under contract with the state, received notice in December that CMS reversed its 2015 rejection for federal certification, ruling that paroled inmates did not meet federal guidelines.
